Offenses Against Computer Users
When charged with an offense against computer users, the subject is alleged to have accessed without permission:
- the computer and/or network of another,
- disrupt, deny, or cause the denial of computer system services of another,
- destroy, take, damage, or injure computer equipment or supplies of another used or intended to be used in a computer or network, or
- introduce computer contaminants into the computer or network of another.
Based upon certain circumstances and aggravators, the punishment associated with this crime ranges from probation to a 2nd degree felony, punishable by up to 15 years in prison.
Additionally, there are jurisdictional issues that may arise such that an individual may be charged in either the jurisdiction where they caused the computer/network to be accessed, or the in jurisdiction in which they are located.
