Planting a Hoax Bomb
A bomb can be anything from an enhanced M-80 to a weapon of mass destruction. The Government takes bomb threats very seriously, even if the bomb turns out to be a "fake". Florida punishes those who employ "hoax bombs" in nearly any capacity, including:
- making the fake bomb
- threatening to use
- mailing or supplying parts
- attempting to use
- delivering
- selling, or
- displaying
Any of these uses of a hoax bomb may result in a 2nd degree felony charge punishable by up to 15 years in prison. Additionally, if the hoax bomb is used in the commission of a separate felony, an additional 2nd degree felony charge may apply. As with the planting of an actual bomb, if rescue and support personnel are deployed, the perpetrator may be ordered to pay restitution.
